Terms & Conditions

These Terms & Conditions govern use of shivanmusicxx.com and the purchase and use of digital beats and licences created and fulfilled by Shivan Music, operated by Nisha Sharma in India. Contact: prodshivan@gmail.com.

1. Seller, Supplier and Contract

Dodo Payments acts as Merchant of Record and authorised reseller for transactions completed through its checkout. Dodo Payments is the legal seller for payment, tax, invoice, refund and billing purposes; Shivan Music is the supplier, creator, licensor and fulfiller of the digital content. Your purchase is also subject to the Dodo Payments Buyer Terms. If these terms conflict with mandatory consumer law or Dodo's Buyer Terms concerning the sale or payment, those requirements prevail.

2. Orders, Pricing and Delivery

Product prices are displayed in USD. Dodo Payments may present a supported local billing currency and adds applicable taxes at hosted checkout before you confirm payment. An order is accepted only after payment succeeds. Digital files and licence rights are delivered to the email address supplied at checkout through time-limited download links, normally valid for three days and three uses. You are responsible for providing an accurate email address and keeping download links private.

3. Licence and Intellectual Property

Purchasing a beat grants only the Basic, Premium or Exclusive licence selected at checkout. Exact rights and restrictions are stated in the Beat Licensing Policy, which forms part of these terms. Ownership of the underlying composition is not transferred. The licence is personal and non-transferable, and the beat may not be resold, sublicensed, redistributed as a standalone work, or registered as the buyer's original composition.

4. Immediate Digital Performance and Refunds

By requesting immediate delivery, you consent to performance beginning after successful payment and acknowledge that any statutory cancellation or withdrawal right may end when delivery or downloading begins. This does not remove rights that cannot legally be waived. Refunds, non-delivery and defective-file issues are handled under our Refund & Cancellation Policy and Dodo's Buyer Terms.

5. Acceptable Use and Buyer Responsibility

You are responsible for lyrics, vocals, samples and other material added to a beat, for obtaining third-party permissions, and for ensuring the resulting work is lawful and does not infringe intellectual-property, privacy, publicity or other rights. You must not use the files for unlawful, hateful, defamatory, fraudulent or deceptive content.

6. Disclaimer and Liability

Digital files are supplied as described for the selected licence. To the extent permitted by law, Shivan Music is not liable for indirect or consequential loss, platform takedowns, lost revenue, or claims caused by the buyer's modifications, distribution, unlawful use or third-party content. Nothing in these terms excludes liability or consumer remedies that cannot legally be excluded.

7. Governing Law and Contact

These supplier and licensing terms are governed by the laws of India, without limiting mandatory consumer protections that apply in the buyer's country. Please first send any concern to prodshivan@gmail.com so it can be resolved promptly.
